A minimum wage is an employee’s bottom grade of pay for ordinary hours worked, and is usually dependent on the commercial tool that applies on their work (for instance, a modern award, enterprise agreement, transitional pay level, or nationwide minimum income order).
The smallest amount of wages attained by employees in the nationwide workplace relations set up are evaluated by the Fair Work Commission yearly, with any alterations taking effect on 1st July each year. The report concerns the rates of pay inside the current awards and in the nationally recognised lowest wage.
The minimum wage earned by people inside the national workplace relations system are controlled yearly by a specialised Minimum Wage Panel of the Fair Work Commission (prior to now referred to as Fair Work Australia). Fair Work Australia’s first yearly pay review was introduced on 3rd June 2010. Any determinations given to change minimum wage in current awards or a national minimum wage order will apply from the 1st full payment time period on or soon after 1 July every year.
The Fair Work Commission have got to broadcast any altered income rates in a new award (as a result of an Annual Wage Review Determination) prior to 1 July yearly. Variations to a national minimum income order must also be available as soon as practical.
From 1 January 2010, present day awards displaced a great number existent awards and transitional wage scales, and offer the minimum terms and conditions for workers in particular fields and professions. Whereas present day awards include minimum wages, some current awards include transitional workplace mediation provisions available, beneath which the wage-related features could be phased in over 5 years.
Business owners should assess their relevant modern awards to understand if transitional provision apply. If there are no transitional provision, the modern award pay amounts are applied from 1st January 2010.
The federal government minimum wage is currently $15.96 per hour or $606.40 per 38 hour week. Casual workers encompassed by the nationwide minimum pay also get at least a 22 percent casual loading.
An employer cannot contravene a term of a current award or a nationwide lowest income order. Suspected contraventions will be looked at and enforced by the Fair Work Ombudsman. A violation of a term of a present day award or a nationwide lowest wage order may give rise to penalties of up to $10,200 for an person and $51,000 for a corporation.
